Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case is of 25 bottles of codeine phosphate from the possession of another accused. There has been no recovery from the present petitioner, as such, petitioner prays for bail. Learned advocate for the State opposes the prayer for bail and submits that the investigation of the case is still still in progress. Having considered the submissions of the learned advocate for the State that the investigation is in progress, at this stage, I am not inclined to release the petitioner on bail. However, the learned trial court would assess if there is no further recovery in 2 connection with the instant case apart from 25 bottles of codeine phosphate which has already been seized after submission of charge-sheet, petitioner be released on bail on such terms and conditions as the learned special court deems fit and proper. With the aforesaid observations, CRM(NDPS)1297 of 2026 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
