APP Ms. Tanusree Kar ……for the State. Report submitted by the State in respect of service being effected upon private opposite party be kept with the record. Learned advocate appearing for the petitioner submits that he is innocent of the charges and has been foisted in the instant case. Case Diary has been produced and attention of the Court has been drawn to the statement under Section 183 of the BNSS. Having considered the information which has been divulged, I am of the opinion that although a case has been made out but custodial interrogation may not be warranted in the facts of the present case. Accordingly, the prayer for anticipatory bail of the petitioner is allowed. 2 As such, I direct that in the event of arrest, the petitioner be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Petitioner shall once in a week meet with the investigating officer of the case till the charge-sheet is submitted before the jurisdictional Court. With the aforesaid observations CRM (A) 665 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
