Heard the parties.

The petitioner has challenged the order as contained in Memo No.1240 dated 23.08.2017, whereby the petitioner has been punished.

After going through the writ petition, I find that after a proper departmental proceeding, the petitioner has been punished. The punishment is of censure and stoppage of two increments with cumulative effects.

The petitioner is challenging the order of 2017 by filing this writ petition. There is no ground mentioned in the writ petition as to why the petitioner has taken nearly eight and half years to approach this Court. Further, it has been submitted by the petitioner that the petitioner had earlier challenged the initiation of a department proceeding in WP(S) No.299 of 2017 and the during the pendency of this aforesaid writ petition, this final order as contained in Memo No.1240 dated 23.08.2017 i.e., impugned
order of this case was already passed. It was also been brought to the notice of this Court that during argument a liberty was given

to challenge the same before an appropriate authority. The petitioner did not challenge the same but again has filed the writ petition, though the order was appealable. After 08 long years, I am not inclined to entertain this writ petition, when it was well within the knowledge of this writ petitioner that the order was passed in 2017 and further liberty was given in 2019 to file an appropriate application. This is a case of gross negligence. Thus, I am not inclined to exercise my discretionary jurisdiction.

Accordingly, this writ petition is dismissed.
