ORDER : Questioning the notice issued under Section 6 of Andhra Pradesh Land Encroachment Act, 1905 (for short ‘the Act’) by the 4th respondent vide Rc.B No.268/2026, dated 03.06.2026, directing the petitioner to vacate the land in an extent of Ac.0.40 cents in Survey No.534 of Ramasagaram village, Sydapuram Mandal, SPSR Nellore District, the petitioner filed the present Writ Petition.
2. Heard Sri Kambhampati Ramesh Babu, learned counsel for the petitioner and learned Government Pleader for Revenue.

Learned counsel for the petitioner submits that a notice under Section 7 of the Act was sent by the 4th respondent to the petitioner's mobile phone through WhatsApp on 15.05.2026. However, the petitioner could not see the said notice due to oversight.
4. In view of the above facts and circumstances, the Writ Petition is
disposed of, at the stage of admission, directing the petitioner to submit his explanation to the notice issued under Section 7 of the Act by the 4th respondent within a period of one (01) week from today. Upon receipt of such explanation, the 4th respondent is directed to examine and pass appropriate orders, in accordance with law, within a period of four (04) weeks thereafter.
5. Till such time, the 4th respondent is directed not dispossess the petitioner from the subject land admeasuring Ac.0.40 cents in Survey No.534 of Ramasagaram Village, Sydapuram Mandal, SPSR Nellore District.

6. Consequently, the impugned Proceedings of the 4th respondent in Rc.B No.268/2026, dated 03.06.2026, are hereby set aside. There shall be no order as to costs.
