1. None appears on behalf of the applicant to press this bail application when the case is called out. 2. It transpires from the record that the applicant is in jail since

The applicant has preferred this second bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail, as he has been arrested in connection with Crime No.51/2025, registered at Police Station Sanna, District- Jashpur (C.G), for the offences punishable under Sections 296, 351(3), 115(2), 333, 109(1), 332(b), 3(5) of BNS. 4. The case of the prosecution, in brief, is that on the night of 30.04.2025, the applicant, Aghnu @ Haga, along with the co- accused, allegedly trespassed into the house of the complainant after abusing and threatening her family with dire consequences. It is alleged that, in furtherance of their common intention to commit the murder of the complainant's mother, Phoolmati Bai, the applicant assaulted her on the head with an iron spade, causing serious injuries. On the basis of the complaint, an FIR was registered, and during investigation, the iron spade allegedly used in the offence was recovered at the instance of the applicant pursuant to his memorandum statement. Medical evidence corroborated the head injury sustained by the victim, and upon completion of investigation, the charge-sheet was filed before the competent Court. Hence, the bail application. 5.
From perusal of the bail application, it transpires that the first bail application of the applicant was rejected by this Court vide order dated 06.11.2025 passed in MCRC No.8710 of 2025, therefore,
3 the applicant has preferred present second bail application on the ground that the applicant is in jail since 17.08.2025, so far as the status of trial is concerned, the same is not mentioned in the bail application. 6. On the other hand, learned State counsel opposes the bail application and submits that the applicant allegedly in collusion with co-accused, criminally trespassed into the complainant's house after abusing and threatening her family and, in furtherance of their common intention, assaulted Phoolmati Bai on the head with an iron spade with the intention of causing her death. Furthermore, the iron spade used in the offence was recovered at the instance of the applicant during the investigation. Therefore, the applicant is not entitled for grant of bail. 7. I have perused the case diary. 8. From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the applicant was rejected by this Court vide order dated 06.11.2025 in MCRC No. 8710 of 2025 on the ground that the specific overt act attributed to the applicant of assaulting the victim on the head with an iron spade, the prima facie material available in the case diary, the recovery of the weapon at his instance, and the medical evidence corroborating the injuries. The allegations disclose the commission of serious offences, including house trespass, criminal intimidation and attempt to murder, further there appears
4 to be no good ground to entertain the present second bail application of the applicant. 9. Accordingly, the bail application of applicant-Aghanu @ Haga, involved in Crime No.51/2025, registered at Police Station Sanna, District- Jashpur (C.G), for the offences punishable under Sections 296, 351(3), 115(2), 333, 109(1), 332(b), 3(5) of BNS, is rejected. 10.
Needless to say that the tail Court concerned is at liberty to proceed and conclude the trial expeditiously. 11. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. 12. After passing of the order Mr. Jitendra Kumar Saxena, learned counsel for the applicant appeared and submits that his presence may be marked. Sd/-
