Kausik CRM (A) 1789 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Narkeldanga Police Station Case No. 324 of 2026 dated 11.06.2026 under Sections 318(4)/75(1)/79/351(2)/3(5) of the BNS, 2023. And In the matter of : Arvind Singh ……Petitioner. Mr. Rudradipta Nandy Mr. Anirban Dutta ……for the Petitioner. Mr. Amal Kumar Dutta ……for the State. Learned advocate appearing for the petitioner submits that petitioner happens to be brother of the local representative/councilor. As such, he has been implicated in connection with the instant case. The said accused was arrested and has been subsequently granted bail. So far as the petitioner is concerned, learned advocate for the State opposed the prayer for anticipatory bail and drew the attention of the Court to the statement of the victim. I have taken into account the statement of the victim which is categorically pointed to the other accused who was already arrested. 2 Having considered the locus of the present petitioner, I am of the opinion that his custodial detention may not be warranted in the facts and circumstances of the present case. Accordingly, the prayer for anticipatory bail of the petitioner in Narkeldanga Police Station Case No. 324 of 2026 dated 11.06.2026 is allowed. As such, I direct that in the event of arrest, the petitioner be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since the investigation of the case is in progress, petitioner, as and when called for, would meet the investigating officer of the case. Accordingly, CRM (A) 1789 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
