Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 10 months and is similarly situated as the other accused person who has been granted bail in CRM(M)339 of 2026. Learned advocate for the de facto complainant opposes the prayer for bail and submits that the accused who has been released on bail has violated the conditions and he has been threatening the witnesses. To that effect, information has been sent to the appropriate authority. 2 Learned advocate for the State opposes the prayer for bail and submits that in the present case the deceased was assaulted with bricks and bamboos. There were recoveries of bamboos pursuant to the leading statement of this petitioner. I have taken into account the overall circumstances and the genesis of the dispute. Having considered the same, I am inclined to release the petitioner on bail. The petitioner, namely, Sk Nasibuddin @ Sekh Nosibuddin be released on bail by the learned trial court on same terms and conditions as was imposed upon Sk. Sanikul @ Sekh Sanikul in CRM(M)339 of 2026. With the aforesaid observations, CRM(M)1254 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
