Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023 the petitioner, namely, Tinku Deka @ Tingku Deka Nath has prayed for release on bail in connection with POCSO Case No. 162/2025 arising out of Morigaon P.S. Case No. 226/2025 pending in the Court of the learned Special Judge (POCSO), Morigaon. In the case before the trial Court, the victim has already examined. It is submitted that the petitioner is only 18(eighteen) years of age. Considering entire aspect of the matter, this Court is of the opinion that the petitioner does not deserve to be detained in custody any longer. Therefore, the bail application of the petitioner is allowed. Accordingly, it is hereby directed that the petitioner Tinku Deka @ Tingku Deka Nath is allowed to go on bail in connection with POCSO Case No. 162/2025 arising out of Morigaon P.S. Case No. 226/2025 pending in the Court of the learned Special Judge (POCSO), Morigaon on executing a bail bond of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Special Judge (POCSO), Morigaon. The petitioner is directed to appear before the learned Trial Court on each and every date of hearing failing which the Trial Court shall have the liberty to take steps for procuring his attendance in accordance with law.
