The State of West Bengal Mr. Jisan Iqubal Hossain ..for the petitioner Mr. Subir Ganguly Mr. Sandeep Prasad Shaw ..for the State Learned advocate appearing on behalf of the petitioner submits that, due to the petitioner's absence on a single occasion, the learned Judge in the Court below, by an order dated September 29, 2023, issued a warrant of arrest against him. It appears that the next date has been fixed by the trial Court on September 19, 2026 for the purpose of framing of charge. Learned advocate further submits that the petitioner is willing to surrender before the learned trial Court. In view of the aforesaid submission, the warrant of arrest issued against the petitioner shall remain stayed for a period of one month from the date of this order, subject to the condition that the petitioner shall surrender before the learned trial Court within the said period. In the event the petitioner surrenders before the learned trial Court, any application for bail filed by him shall be considered and decided on its own merits and in accordance with law, without being influenced by any observations contained in this order. In the event the petitioner fails to surrender within the stipulated period in terms of this order, the warrant of arrest shall stand revived automatically, and the learned trial Court shall be at liberty to execute the same in accordance with law. Accordingly, CRR 2429 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
