This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.155/2026 registered at Police Station – Tarbahar, District – Bilaspur (C.G.) for the offence punishable under KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.24 11:17:08 +0530 2 Sections 112, 3(5), 318 (4) of the BNS. 2. The prosecution story, in brief, is that on 13/05/2026, P.S.- Tarbahar, received a tip from an informant stating that a person wearing a black T-Shirt was standing near the State Bank of India in Vyapar Vihar, Bilaspur, trying to lure passersby into sharing their bank account numbers in exchange for a commission. Acting on the said information received, a unit of Tarbahar police reached the spot and apprehended the Individual who attempted to flee upon seeing the Police, who have been identified as Dipesh Kumar Gupta, a 21 year old, resident of Village- Sirsi, District- Surajpur C.G.). From the arrested person, Police has recovered, a Samsung mobile phone and upon opening the device, the Police discovered multiple bank account details from various banks being shared on WhatsApp with contacts Lamed Vicky Pandit, Shubham Patel, Ayush, Aamir, Imas, and others. On the same day i.e. on 13/05/2026, Police Station Tarbahar, Bilaspur registered First Information Report. Hence, the bail application. 3. Learned Senior counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant is 22 years old boy and is prosecuting his B. Tech degree and has unblemished track record and does not have any criminal antecedent. Therefore the applicant be released on bail. 4. On the other hand, learned State counsel oppose the prayer for 3 grant of anticipatory bail to the applicant on submission that in compliance of the order passed by this Court on 16.7.2026, the concerned I.O. has filed the affidavit stating that the present applicant was involved in providing mule account numbers of different banks and in turn the details were forwarded to next layer of mule account holders in lieu of which the applicant used to get commission. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Perusal of the affidavit filed by the IO would show that the same fails to demonstrate as to what transaction has taken place in a particular account and whether any particular amount has been credited or debited is not mentioned. 7. Considering the facts and circumstances of the case, particularly considering the allegation levelled against the applicant and the fact that the applicant is a student who is prosecuting his B.Tech degree and that the applicant does not have any criminal antecedent, as such, this Court is inclined to extend the benefit of anticipatory bail to the applicant. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Shubham Kumar Patel, on executing a personal bond with one surety in the like sum to the satisfaction of the Arresting Officer, he shall be released on bail on the following conditions:- 4 (a) He should not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He should not act in any manner which will be prejudicial to fair and expeditious trial. (c) he should appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The Applicant and the sureties shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
