Accused No.3 in Crime No.78 of 2026 registered by Robertsonpet Police Station, KGF, for the offence punishable under Section 20(b)(ii)(B) of NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.78 of 2026 was registered by Robertsonpet Police Station, KGF for the aforesaid offence against Prajwal and two others, based on first information dated 12.05.2026 received by one Mahesh Mali, Police Officer attached to Robertsonpet Police Station. During the course of investigation of the said case, the petitioner herein was - 3 - HC-KAR CNR: KAHC010370212026 NC: 2026:KHC:36672 CRL.P No. 7723 of 2026 arrested on 13.05.2026 and remanded to judicial custody. His bail application filed before the Trial Court in Crime No.78 of 2026 was rejected on 22.05.2026. Therefore, he is before this Court. 4. The reading of the first information dated 12.05.2026 would reveal that based on the credible information received on 12.05.2026 at about 11.45 a.m., when the first informant was in the police station, a raid was conducted to the alleged place where the accused persons were attempting to sell the contraband articles to the public, within the jurisdiction of Robertsonpet Police Station. Accused Nos.1 and 2 were apprehended from the said spot and from their possession contraband article allegedly ganja totally weighing 2 kgs 450 grams was recovered and seized under the mahazar. 5. It appears that accused Nos.1 and 2 had informed the police that they had brought the contraband article allegedly ganja from Orissa and had handed over a portion of the same to the petitioner herein for sale. It is under the circumstances, petitioner was subsequently arrested at Kuppam - 4 - HC-KAR CNR: KAHC010370212026 NC: 2026:KHC:36672 CRL.P No. 7723 of 2026 in Andhra Pradesh State and was produced before the Trial Court and remanded for judicial custody. 6. It is not in the dispute that there is no seizure of any contraband articles from the possession of the petitioner in the present case. It is also not in the dispute that he has no other criminal antecedents. Under these circumstances, the prayer of the present petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. 7. Accordingly, the following: ORDER (i) Criminal Petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.78 of 2026 registered by Robertsonpet Police Station, KGF for the offence punishable under Section 20(b)(ii)(B) of NDPS Act, 1985, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties (out of - 5 - HC-KAR CNR: KAHC010370212026 NC: 2026:KHC:36672 CRL.P No. 7723 of 2026 which one must be local surety) for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the date of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
