(ORAL) CM-4875-CWP-2026 The present application has been filed under Section 151 CPC for disposal of the present writ petition in terms of the judgments dated 20.12.2024 & 06.11.2025 (Annexures P-52 & P-53, respectively). Keeping in view the facts mentioned in the application and since the main case is listed for 03.09.2026, the application stands allowed and with the consent of both the parties, the main case is hereby preponed and is taken up on board today itself. The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the action of the respondent-University in rejecting the claim of the petitioner for the absorption on regular basis or in the alternative to allow her to continue till the regular selection and to grant pay scale of the post in view of the principle of ‘equal pay for equal work’ vide order dated 02.03.2015 (Annexure P-18). Further, for issuance of a writ in the nature of mandamus directing the respondents to absorb the petitioner on regular basis.

Learned counsel for the petitioner has limited her prayer to the extent that the present petition be treated as a comprehensive representation and the same be decided in a time bound manner in the light of judgments passed by Hon’ble Supreme Court in Jaggo v. Union of India and others 2025 AIR SC 296; Dharam Singh and Others v. State of U.P. and another 2025 SCC OnLine SC 1735 and Shripal & Anr. v. Nagar Nigam, Ghaziabad 2025 SCC OnLine SC 221 and also the judgment rendered by the Coordinate Bench of this Court in CWP No.26899 of 2025 titled as Nishi and another vs. Panjab University and others decided on 06.11.2025, by passing a speaking order after affording the petitioner an opportunity of being heard, as the claim of the NEHA 2026.07.13 11:14 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh
CM-4875-CWP-2026 & CM-4896-CWP-2026 in/and CWP-8117-2015 -3- petitioner is squarely covered by the aforesaid judgments and the petitioner is performing perennial duty which are essential for the functioning of the respondent-University, as such, she is entitled to regularization on the strength of her continuous service rendered for over the two decades. 3. Mr. Naveen Kumar, Advocate for Mr. A.S. Virk, Advocate for the respondents submits that the grievance raised by the petitioner in the present writ petition would be considered by passing a speaking order in accordance with the law by respondent No.1. 4. Therefore, in view of the submissions made by the learned counsel for the parties, the present writ petition is disposed of and the respondent No.1 is directed to treat this writ petition as a comprehensive representation and consider the claim of the petitioner in the light of judgments passed by Hon’ble Supreme Court in Jaggo v. Union of India and others 2025 AIR SC 296; Dharam Singh and Others v. State of U.P. and another 2025 SCC OnLine SC 1735 and Shripal & Anr. v. Nagar Nigam, Ghaziabad 2025 SCC OnLine SC 221 and also the judgment rendered by the Coordinate Bench of this Court in CWP No.26899 of 2025 titled as Nishi and another vs. Panjab University and others decided on 06.11.2025 and pass a speaking order after affording her an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order.
Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.1.
