For Petitioner(s): Mr.N.Ishak For Respondent(s): Mrs.S.Pavithra, Standing Counsel for R1-2 Mr.C.S.K.Sathish, Standing Counsel for R3 ORDER The writ petition is filed for the relief set out below: "directing the respondents to pay interest amounts to the petitioner for the belatedly paid Service Gratuity, Provident Fund and Commutation of pension along with the arrears payable on account of 15th Wage Settlement at the rate of 6 percent per annum for 8 months of delayed payment in the light of the judgment passed by this Court on 23.10.2024 in W.P.No.30766 of 2024 by considering the representation dated 20.03.2026." 2. It is the case of the petitioner that he was appointed as "Conductor" in the Respondent Corporation and retired from service on attaining the age of superannuation. After his retirement, the respondent settled his terminal benefits belatedly based on salary paid. Therefore, the respondents are legally entitled to pay the interest to the same. While so, the 15th wage settlement was implemented and wage revision was given effect. Therefore, the respondents has to revise the pension, difference in leave salary and gratuity and settle the same. https://www.mhc.tn.gov.in/judis WP No. 17011 of 2026 __________ Page3 of 4 3. The petitioner had made a representation to the respondents to pay him the interest for the belated period along with the arrears payable on account of implementation of 15th wage settlement with 6% interest. However, the same had not been considered to date by the respondents. Hence, the petitioner is before this Court. 4. Heard the learned Counsel on either side and perused the records. 5. Considering the limited request of the petitioner and taking note of the fact that the petitioner’s representation has not been considered to date by the Respondents, a mandamus, is therefore, directing the respondents to pay 6% interest amount to the Petitioner for belatedly paid Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension for the delayed period and to pay eligible amount if any, under the 15th wage settlement along with interest at the rate of 6% per annum for the delayed period within a period of six weeks from the date of receipt of a copy of this order. 6. Accordingly, this Writ Petition is disposed of.
