Kausik (Allowed) CRM (NDPS) 1197 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Krishnaganj Police Station Case No. 465 of 2025 dated 27.10.2025 under Sections 21(c)/20(b)(ii)/29 of the NDPS Act, 1985. And In the matter of : Anarul Mondal @ Md Anarul Mondal ……Petitioner. Mr. Abdul Aziz Mondal ……for the Petitioner. Mr. Pinaki Bhattacharyya, Sr. Govt. Adv. ……for the State. Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case is 48 bottles of Phensedyl and 8.750 Kgs. of Ganja. Petitioner was arrested and there was recovery from the petitioner and is in custody for 8 months and 21 days. Charge sheet has already been submitted and the prosecution has relied upon 10 witnesses in support of its case. Learned advocate for the State opposes the prayer for bail and submits that the incident happened in the border area. However, there are no antecedents of the petitioner as has been submitted on a query from this Court. 2 Having regard to the period of detention and the time which will be consumed and that there are no antecedents of the petitioner, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Anarul Mondal @ Md Anarul Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, Krishnanagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1197 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
