Partha Ghosh -vs- Mr. Manish Jain & Ors.
Mr. Tarun Kumar Das
…for the petitioner Mr. Sardar Amjad Ali, sr. adv. Mr. Maheswar Malo Das
…for respondent no.4
Mr. Sardar Amjad Ali, learned Senior Advocate appearing for respondent no. 4, submits that the petitioner had been dismissed from the service of the University pursuant to a disciplinary proceeding initiated against him. The alleged contemnor is personally present before this Court. Although his conduct appears to have been wholly unbecoming and would otherwise have warranted appropriate action, it is noted that he has filed an affidavit today tendering an unconditional apology. The alleged contemnor has also been examined by this Court and, during the course of such examination, has unequivocally tendered an unconditional apology for his conduct. In view of the aforesaid facts and circumstances, this Court is not inclined to impose any further punishment upon the alleged contemnor.
2
Having regard to the unconditional apology tendered before this Court, the contempt proceeding is dropped. The Rule issued against the alleged contemnor stands discharged. Accordingly, WPCRC 206 of 2023 is disposed of.
