1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 21(C) of the NDPS Act. 3. Learned counsel for the petitioners submits that petitioners have antecedent of four cases and the informant alleges that on 26.05.2026 at 07:50 PM, while patrolling, he received a secret information that named accused persons including the petitioners indulge in business of codeine cough syrup and injection near Bagha 48 railway crossing and the accused persons in two vehicles parked in an open field near

No.49594 of 2026(2) dt.13-08-2026 2/3 Bagha 48 railway crossing have concealed narcotics substance, accordingly the informant reached the place of occurrence and found two vehicles parked and on enquiry from nearby people, it was disclosed that the petitioners indulge in business of illegal substance with the help of the aforesaid two vehicles, accordingly the vehicles (cars) were searched and 67 liters of codeine coup syrup along with 4300 ML of pentazonic injection were recovered from the car as detailed in the FIR. 4. Learned counsel appearing on behalf of the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is further submitted that since petitioners have criminal antecedent, as such, the informant implicated him based on secret information, it is also submitted that the vehicle from which the alleged codeine coup syrup along with pentazonic injections were recovered does not belong to the petitioners and a pleading to that effect has been made at Para-10 of the anticipatory bail application. 5.

Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioners and submits that petitioners have antecedent of four cases and allegations are serious and of late in the State of Bihar young generation has started using codeine for the purposes of intoxication, hence

No.49594 of 2026(2) dt.13-08-2026 3/3 interrogation of the petitioners is required, it is also submitted that if privilege of anticipatory bail is granted, the petitioners may abscond try to tamper with the evidence. 6. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioners. 7.
