1. Affidavit of service filed on behalf of the petitioner is taken on record.
2. Learned advocate representing petitioner submits that concerned police authorities have not taken steps on receiving complaint from the petitioner. Moreover, it is submitted that a decree was passed by Civil Court in favour of petitioner and such decree needs to be implemented. Prayer is made for giving direction upon the concerned police authorities to provide protection.
3. Mr. Suryaneel Das, learned Additional Government Pleader representing State respondents has opposed this writ petition
2 since issue involved in this writ petition is civil in nature. It is also submitted that for registering FIR writ petition may not be entertained.
4. Having considered the respective submissions made on behalf of the parties it needs to be observed herein if civil court passed a decree in favour of petitioner in that event petitioner needs to put the same into execution. Furthermore, inaction on the part of the concerned police authorities in registering FIR ought not to be ground to entertain the writ petition in view of availability of alternative remedy under Section 175(3) BNSS 2023 by approaching jurisdictional Magistrate.

Moreover, it is disclosed in the communication dated 20th July, 2026 of Inspector-in- Charge, Raidighi Police Station, Sundarban Police District after receiving complaints from the petitioner it was found by the concerned police authority that no cognizable offence was alleged to have been committed. However, a Non Cognizable Report was submitted on 2nd June, 2026.
6. Copy of the communication dated 20th July, 2026 is taken on record. Copy of the said communication dated 20th July, 2026 is made
3 over to the learned advocate representing petitioner.
7. In above conspectus present writ petition is disposed of thereby directing concerned police authorities to maintain peace and tranquility at the locale and to see that no untoward incident takes place.
8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
