Learned counsel for the petitioner, at the very outset, submits that the order dated 23.09.2024 has been challenged by [2026:RJ-JP:8977] (2 of 3) [CW-3616/2026] way of a revision petition bearing No. 176/2024 along with a stay application before the Joint Secretary, Department of Mines & Geology, Rajasthan, but for one reason or the other, for a period of over one year, no effective order has been passed either on the revision petition or the stay application. 2. Learned counsel submits that a notice of recovery dated 13.02.2026, raising a demand of Rs. 10,74,62,217/- has been issued against the petitioner No.1, and the same has been served upon petitioner No.2 herein, who is the Director of petitioner No.1 – Alliance Quarries Mines Private Limited. 3. Learned counsel further submits that the respondents cannot blow hot and cold, as on one hand they are keeping revision petition filed by petitioner pending and on the other hand they are initiating recovery proceedings against the petitioner(s), thereby rendering the revision petition itself inconsequential. 4. Considering the undisputed position that the revision petition is pending before the competent authority, this Court is not inclined to interfere in the pending proceedings, as any such observation or any order passed by this Court would certainly affect the said proceedings. 5. However, considering the fact that the notice for recovery has been issued on 13.02.2026, learned counsel for the petitioner is granted an opportunity to file application before the Revisional Authority in respect of the said notice for recovery within a period of seven days from today i.e. 26.02.2026 and in the event of any such application being filed by the petitioner, the Revisional Authority is directed to decide the said application within a period of ten days thereafter, by passing a speaking and reasoned order [2026:RJ-JP:8977] (3 of 3) [CW-3616/2026] after granting an opportunity of hearing to the parties, strictly in accordance with law. 6. Till the decision of the said application is made and for a period of five days thereafter, further proceedings in pursuance of notice of recovery dated 13.02.2026 shall not be effected. 7. However, it is specifically clarified that granting of the present protection shall not be considered as any opinion with respect to the merits of the matter and the said application be decided by the Revisional Authority on its own merits without being influenced by this order. 8. Accordingly, with the above directions, the present writ petition is disposed of. 9. Pending application(s), if any, shall also stand disposed of. (ANUROOP SINGHI),J DIPESH CHAYAL /09
