The petitioner is an accused in connection with Mahila P.S. Sadar Chaibasa Case No. 5(S) of 2024 corresponding to Spl. POCSO Case No. 41 of 2024. It has been alleged that the uncle of the informant had commited rape upon the informant on numerous occasions. It has also been alleged that two other persons including the petitioner have also subjected the victim to rape. Submission has been advanced by the learned counsel for the petitioner that the main allegation of committing rape upon the victim is attributed to the uncle of the victim. He further submits that the FSL report does not support the fact that the petitioner had also committed rape upon the victim. He further adds that the petitioner is in custody since 22.10.2024. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner. The victim has been examined as P.W. 1 and she has identified the petitioner as the person who had committed rape upon her. Regard being had to the above, I am not inclined to admit the petitioner on bail and the present application is hereby rejected. (Rongon Mukhopadhyay, J) R. Shekhar Cp 3
