Kausik (Allowed) CRM (NDPS) 1199 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hogolberia Police Station Case No. 227 of 2024 dated 12.09.2024 under sections 20(b)(ii)(c)/25/29 of the NDPS Act. And In the matter of : Saddam Sha & Anr. ……Petitioners. Mr. Prabir Majumder Mr. Snehansu Majumder Ms. Anindita Kundu ……for the Petitioners. Mr. Goutam Dey Mr. Ranajit Ghosh ……for the State. Learned advocate appearing for the petitioners submits that the alleged recovery in the present case is 41 Kgs. 850 Gms. of Ganja. Petitioners earlier approached this Court when there was a specific direction for at least completing the seizure list witnesses within a period of 3 months from the date of consideration of charges. The said order was passed by this Court on 27th November, 2025. In spite of three schedule being fixed by the learned Trial Court, after the charges in the month of March, April and May only a police officer who was present at the time of seizure has been examined. None of the independent witnesses till date has been examined. 2 Learned advocate for the State opposes the prayer for bail. I find that the petitioners are in custody for 22 months. Having considered that there is no possibility of the trial concluding in a reasonable period of time as there are 14 witnesses, I am inclined to release the petitioners on bail. Accordingly, Petitioners, namely, (1) Saddam Sha, (2) Rakibul Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, Krishnanagar, Nadia. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1199 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
