Kausik (Allowed) CRM (NDPS) 1081 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hemtabad Police Station Case No. 293 of 2025 dated August 30, 2025 under Sections 21(c)/25 of the NDPS Act, 1985. And In the matter of : Khokan Mandal @ Khokan Mondal ……Petitioner. Mr. Himanshu De, Sr. Adv. Mr. Navanil De Mr. Shoumilya Mazumder Mr. Debarshi Mukhopadhyay ……for the Petitioner. Mr. L. Vishal Kumar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 10 months and the recovery in the present case relate to 800 bottles of Phensedyl. Charge sheet has been submitted and the prosecution has relied upon 12 witnesses. Learned advocate for the State opposes the prayer for bail. So far as the present case is concerned, there has been recovery. However, there is no criminal antecedent of the present petitioner and the evidence of the 12 witnesses will consume some time. As such, the petitioner be released on bail. 2 Accordingly, Petitioner, namely, Khokan Mandal @ Khokan Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 1st Court, Raiganj at Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Uttar Dinajpur without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1081 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
