Kausik (Allowed) CRM (NDPS) 1107 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 57 of 2026 dated 12.01.2026 under Section 21(C)/25/27A/29 of the NDPS Act. And In the matter of : Firoj Sk ……Petitioner. Mr. Arup Kumar Bhowmick ……for the Petitioner. Mr. Shataroop Purkayastha ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 6 months. Charge sheet has already been submitted before the jurisdictional Court and the subject matter of the case relate to alleged recovery of 73 bottles of Codeine Phosphate Solution. Learned advocate for the State oppose the prayer for bail. The report which has been submitted by the Police also do not reflect any criminal antecedent of the present petitioner. Having considered the overall circumstances, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Firoj Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two 2 sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1107 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
