APP Mr. Amartya Mohan Bhattacharyya … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody since November, 2025 and charge- sheet has already been submitted in connection with the instant case. Learned advocate again submits that out of the 25 witnesses cited in the charge-sheet, only two witnesses have been examined. Learned advocate for the State opposes the prayer for bail. The records of the case speak that although the case was commenced under Section 103(1)/80(2)/3(5) of the BNS, but, the charge-sheet was submitted under Sections 85/80(2)/316(2)/3(5) of the BNS. 2 Having considered that the prosecution has relied upon 25 witnesses in order to prove its case, I am of the view that the petitioner may be released on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Najmul Hossain shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Barasat, North 24 Parganas. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of North 24 Parganas without prior permission of the learned trial court. Accordingly, CRM (M) 1259 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
