Kausik (Allowed) CRM (M) 1237 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gazole Police Station Case No. 610 of 2024 dated 24.07.2024 under Sections 310(2)/311/317(3)/317(4)/118(2)/109(1)/111/49/61(2) of the BNS, 2023. And In the matter of : Samir Mondal @ Tapas ……Petitioner. Mr. Sanat Kr. Das Mr. Sujan Chatterjee Mr. Rohan Bavishi ……for the Petitioner. Mr. L. Vishal Kumar Mr. Neel Chakraborty ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 1 year 11 months and is similarly placed as the other accused who has been granted bail in CRM (DB) 555 of 2025. Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that the present petitioner and Masum Raja Mostakin @ Masum Reja are not similarly placed. Having considered the period of detention of the present petitioner and the possibility of the trial not being concluded very soon, I am inclined to release the petitioner on bail. 2 Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Samir Mondal @ Tapas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1237 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
