102.WP.5236.2026 1/3 IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH, NAGPUR WRIT PETITION NO. 5236 OF 2026 Ekvira Gittikhadan Majur Sahakari Sanstha Vs. State of Maharashtra, through its State Minister, Department of Co-operation, Marketing and Textiles, Mumbai ______________________________________________________________________________ Office Notes, Office Memoranda of Coram, Appearances, Court's orders of directions Court's or Judge's order and Registrar's orders. Mr. Parth Malviya, Advocate for the Petitioner. Mr. D.P. Thakare, Addl. G.P. for the Respondent/State. ------------------------------- CORAM : ANIL S. KILOR AND R AJ D. WAKODE , JJ. DATE : 10.07.2026 Heard Mr. Parth Malviya, learned counsel for the petitioner. 2. The petitioner is a Co-operative Society, which has approached this Court seeking a direction to the respondent/State of Maharashtra to decide the Revision Application filed under Section 154 of the Maharashtra Co-operative Societies Act, 1960, on 27th January, 2026, within a stipulated period. 3. The contention is that the petitioner-Society, in its Special General Meeting held on 20th December, 2024, passed Resolution No.2 for amendment of By-law No. 7(1). On 30th December, 2024, the petitioner-Society submitted the aforesaid amendment proposal to the learned Assistant Registrar, Co-operative Societies, Savali, for approval. The learned Assistant Registrar, Co-operative Societies, rejected the said amendment proposal on 17th February, 2025. The said 2026:BHC-NAG:8735-DB 102.WP.5236.2026 2/3 order was challenged in an appeal before the Divisional Joint Registrar, Co-operative Societies, Nagpur, which also came to be dismissed on 8th December, 2025. 4. Being aggrieved by the aforesaid orders, the petitioner- Society approached the respondent/State of Maharashtra by filing the aforesaid Revision Application under Section 154 of the aforesaid Act on 27th January, 2026. It is submitted that more than six months have lapsed, yet the aforesaid revision has neither been decided nor taken up for final hearing by the respondent. The petitioner-Society has made several representations/applications seeking early hearing of the aforesaid revision, which are collectively marked as Annexure-F. In spite of such repeated requests made by the petitioner- Society, the respondent has not decided the aforesaid revision. Hence, the present writ petition. 5. Since the petitioner-Society has approached this Court with an innocuous prayer seeking a direction to the respondent to decide the aforesaid revision within a stipulated period, which is otherwise a statutory duty cast upon the respondent, we dispose of the present writ petition with a direction to the respondent/State of Maharashtra to decide the aforesaid Revision Application filed by the petitioner-Society, which is at record page No.35 (Annexure-E), within a stipulated period of eight weeks from the date of production of this order. 6. Any decision taken thereupon shall be communicated to the petitioner within a period of two weeks thereafter. 102.WP.5236.2026 3/3 7. The writ petition is accordingly disposed of. No costs. (RAJ D. WAKODE, J.) (ANIL S. KILOR, J.) Vijaykumar
