Kausik (Rejected) CRM (NDPS) 1114 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nodakhali Police Station Case No. 495 of 2024 dated 21.12.2024 under section 20(b)(ii)(c)/29 of the NDPS Act. Learned advocate appearing for the petitioner submits that the recovery in the present case is of 25.260 Kgs. of Ganja and the petitioner is in custody for 1 year and 5 months. There is no possibility of the trial concluding, as such the petitioner may be released on bail. Learned advocate for the State has produced the report which reflects that there were two seizures in the present case. Initially 23.210 Kgs. of Ganja were seized. Subsequently, there has been seizure of 25.260 Kgs. of Ganja. The total seizure in the present case is more than 48 Kgs. 2 Having considered the overall circumstances in the present case and the seizure list witnesses have supported the prosecution case, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (NDPS) 1114 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
