CRR 2386 of 2026 Paramananda Ghosh Vs. The State of West Bengal
Ms. Sonali Das Sk. Sahil Ahmed ..for the petitioner The petitioner seeks the expeditious disposal of Sessions Case No. 01(6)2019 (State of West Bengal v. Nabakumar Mondal and 38 Others), pending before the learned Assistant Sessions Judge, Bishnupur, Bankura, arising out of Sonamukhi Police Station Case No. 116 of 2015 dated 27.06.2015, registered under Sections 147, 148, 149, 325, 326, 307, and 506 of the Indian Penal Code. The petitioner is the de facto complainant in the aforesaid case. It appears from the order dated 27th June, 2025, passed by the learned Judge in the Court below, that the matter was fixed on 22nd November, 2025, for the appearance of the accused persons. The said order further reveals that, out of 36 accused persons, only seven were present, while the remaining 29 were absent on petitions seeking exemption from personal appearance. It further appears that charges have not yet been framed in the case. In view of the aforesaid facts and circumstances, this application is disposed of with a direction upon the learned Judge in the Court
below to take appropriate steps in accordance with law, including the issuance of warrants, proclamation, and attachment, against the accused persons in the event of their failure to appear before the Court. In the event all the accused persons appear on the next date fixed for hearing, the learned Judge shall proceed to frame the charges and shall make every endeavour to do so as expeditiously as possible, preferably within a period of three months from the date of communication of this order. Accordingly, CRR 2386 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
