Kausik (Allowed) CRM (M) 1235 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jorasanko Police Station Case No. 498 of 2017 dated 24.10.2017 under section 302/394/34 of the Indian Penal Code, 1860. And In the matter of : Md. Reyaz ……Petitioner. Mr. Raja Mukherjee ……for the Petitioner. Mr. Gouranga Das, Ld. APP Mr. Neel Chakraborty ……for the State. Learned advocate appearing for the petitioner submits that petitioner is similarly placed as the other accused person namely Md. Ashar Firdausi @ Md Ashar who has been granted bail in CRM (M) 337 of 2026. I find that the bail was granted on grounds of Article 21 of the Constitution of India as only 8 witnesses have been examined and 16 witnesses are left to be examined and the petitioner is in custody for 8 year and 9 months. Learned advocate for the State has raised objection relating to the condition of bail at the behest of the accused persons. However, having considered that petitioner is similarly placed as the other accused person who has been granted bail in CRM (M) 337 of 2026, I am inclined that the petitioner be 2 released on same terms and conditions on which the petitioner namely, Md. Ashar Firdausi @ Md. Ashar was released on bail. Thus, CRM (M) 1235 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
