Kausik (Allowed) CRM (NDPS) 1193 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 802 of 2024 dated 04.06.2026 under Section 21(C)/27A/29 of the NDPS Act. And In the matter of : Shibanga Mandal ……Petitioner. Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick ……for the Petitioner. Mr. Debajyoti Deb ……for the State. Learned advocate appearing for the petitioner submits that petitioner surrendered on April, 2026 and has been implicated on the basis of statement of co-accused. The subject matter of recovery in the present case is 758 Gms. of Brown Sugar. The charge has been framed and witness action is about to commence. Prosecution has relied upon 9 witnesses in order to prove its case, as such the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that petitioner was evading the law for about 2 years and after his anticipatory bail was rejected, almost after 17 months, he surrendered before the Court. Petitioner should not be afforded the benefit of bail as prayed for. Learned 2 advocate for the State additionally submitted that there are criminal antecedents of this petitioner. This Court specifically asked the learned advocate for the State as to whether any further investigation is in progress. Having considered that the present set of materials appearing, the only complicity of the petitioner relate to statement of other witnesses only and there has been no recovery from the petitioner, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Shibanga Mandal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1193 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
