Accused in Crime No.82/2026 registered by Peresandra Police Station, Chickballapura, for the offence punishable under Section 318(4) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.82/2026 was registered by Peresandra Police Station, Chickballapura, for the aforesaid offence against petitioner herein based on the first information dated 17.04.2026 received from Byrareddy S/o Byrappa. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.266/2026 before the jurisdictional Sessions Court which was rejected on 10.06.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that since the petitioner has suffered loss in his business, he could not repay the amount. He has already repaid a sum of Rs.1,00,000/- to - 3 - HC-KAR CNR: KAHC010398932026 NC: 2026:KHC:36227 CRL.P No. 8365 of 2026 the first informant. Petitioner has no other criminal antecedents and he is ready and willing to cooperate with the police for the purpose of investigation. 5. Per contra, learned HCGP, who has opposed the petition however, does not dispute the submission made by learned counsel for the petitioner. 6. In the first information, it is alleged that during the period from 04.11.2025 to 06.11.2025, first informant had totally paid a sum of Rs.4,50,000/- to the petitioner, who had promised to deliver potato seeds for the purpose of sowing. Since the petitioner had not delivered the potato seeds in spite of receiving money as aforesaid, first informant had approached the police on 17.04.2026. The submission made by learned counsel for the petitioner that a portion of the money received by him from the first informant has been now repaid is not seriously disputed by learned HCGP. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the same is imprisonment for a period of seven years. Petitioner has no other criminal antecedents and he has - 4 - HC-KAR CNR: KAHC010398932026 NC: 2026:KHC:36227 CRL.P No. 8365 of 2026 undertaken to cooperate with the police for the purpose of investigation. Under the circumstances, the following order:- 7. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.82/2026 registered by Peresandra Police Station, Chickballapura, for the offence punishable under Section 318(4) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
