This Court, having taken note of the fact that what was challenged is merely an approval by the Upa Lokayuktha that a report be obtained from the ACB, which is more in the nature of ordering a preliminary enquiry and not even an - 3 - HC-KAR NC: 2026:KHC:33277-DB RP No. 358 of 2023 investigation is ordered, has disposed of the writ petition reserving liberty to the petitioner to challenge the FIR, if any, registered against him. 4. We are of the considered opinion that there is no prejudice caused to the petitioner since liberty is already reserved to the petitioner to challenge the FIR, if any, registered against him. 5. Learned counsel for the petitioner submits that now an FIR is registered and therefore, all the legal issues raised may be kept open. 6.
