Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than six months; charge-sheet has already been submitted and there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned Public Prosecutor appearing for the State, on the other hand, opposes the prayer for bail on the grounds that the victim was tortured, marriage was solemnized eight months prior to the date of the incident and unable to bear the torture inflicted upon her, victim decided to end her life. There are materials to suggest that torture inflicted upon the victim as well as corroborating materials. I have taken into account the materials appearing in the case diary, the period of detention of the present petitioner and the fact that some time will be required to
2 take the trial to its logical conclusion. Having considered the overall circumstances and the fact that the case was initially registered under Sections 103(1)/80/85/61(2) of the Bharatiya Nyaya Sanhita, 2023 and subsequently charge- sheet has been submitted under Sections 85/80/61(2) of the Bharatiya Nyaya Sanhita, 2023, I am of the view that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Suman Samanta shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Haldia at Purba Medinipur. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Purba Medinipur without prior permission of the learned Court/Trial Court.
The application for bail, being CRM (M) 1249 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
