Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years and till date 10 witnesses have been examined out of 21 witnesses cited by the prosecution. There were earlier rejection of this Court in the month of February, 2026 when there was a direction to complete rest of the witnesses within a period of three months. Be that as it may, the infrastructure of the court did not permit the trial to be completed, as such, without entering into the merits of the case only on the ground of detention, I am inclined to release the petitioner on bail as the petitioner was not identified by any individual in course of the investigation. 2 Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sk Suraj @ Raja shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Chandernagore, Hooghly. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Hooghly without prior permission of the learned trial court. Thus, CRM(M)1256 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
