Mr. Subir Ganguly Mr. Sandeep Prasad Shaw ..for the State The petitioner seeks the expeditious disposal of Sessions Serial No. 330 of 2025, arising out of Bharatpur P.S. Case No. 193 of 2025 dated 19.06.2025, registered under Sections 140(3) and 61(2) of the Bharatiya Nyaya Sanhita, 2023, corresponding to G.R. Case No. 1262 of 2025, which is presently pending before the learned Additional District and Sessions Judge at Kandi, Murshidabad. The petitioner is the de facto complainant in the aforesaid case. It is submitted that, out of a total of 41 prosecution witnesses, only three witnesses have been examined thus far, leaving the remaining witnesses yet to be examined. Having regard to the stage of the trial and the number of witnesses still to be examined, this Court is not inclined to pass any peremptory direction to the learned trial Judge for the expeditious conclusion of the proceedings. However, it is expected that the learned trial Judge shall make every endeavour to proceed with the trial as expeditiously as practicable and shall avoid granting unnecessary adjournments, except where warranted by the interests of justice. With the aforesaid observations and directions, CRR 2327 of 2026 stands disposed of.
