According to the learned advocate, earlier, six witnesses were examined, and, till date, another three witnesses have been examined out of the 19 witnesses cited in the charge-sheet. The records of the case reflect that the deposition of any of the witnesses has been enclosed along with bail application to appreciate regarding the nature of evidence which has been deposed in connection with the instant case. Learned advocate for the State opposes the prayer for bail and emphasizes that during the interregnum, the Judicial Officers were busy otherwise and there is no reason 2 for non-compliance of the order passed by the Hon’ble Supreme Court. Having regard to the same, I direct that if the seizure list witnesses till date have not been examined, the learned trial court would give priority to the evidence of the seizure list witnesses. At this stage, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Rejected. However, the petitioners would approach this court with a fresh prayer after the evidence of the seizure list witnesses is over. Accordingly, CRM (NDPS) 1079 of 2026 is dismissed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
