C.R.M. (M) 1650 of 2026
In Re: An application for Bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kotwali Police Station Case No.278 of 2025 dated 24.05.2025 under Sections 126(2), 115(2), 118(3), 118(2), 109, 61(2), 3(5) adding Section 103(1) of Bharatiya Nyaya Sanhita, 2023;
Akash Mukhi Versus The State of West Bengal
Mr. Anand Keshari Ms. Pubali Debnath Ms. Dhriti Chanda Ms. Sneha Bhattacharjee. …for the petitioner.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 400 days. Charges have not yet been framed. There is no identification of the petitioner appearing from the materials particularly the statement of the witnesses which has been furnished to the present petitioner, as such, the petitioner may be released on bail. Learned advocate for the petitioner has drawn the attention of the Court to the self-declaration which was recorded and is a part of the case records. The deceased at the time of admission divulged that two persons came and poured petrol over him and set him on fire.
Having considered the gruesome manner in which the deceased was attacked, the preparation, as well as the implementation, I am not inclined to release the petitioner on bail at
2 this stage. Petitioner would approach this Court after the evidence of the vulnerable witnesses are over.
Accordingly, CRM(M)1650 of 2026 is dismissed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
