1. Heard on prayer for disposed of the writ petition in light of the amicable settlement arrived at between the parties. 2. Learned counsel for the parties jointly submit that both the parties have amicably resolved their dispute vide report dated 16.3.2025, therefore this petition may be disposed of in terms of the conditions agreed upon in the mediation settlement entered into between the parties. 3. Heard counsel for the parties and perused the Mediation Centre report dated 16.3.2025. 4. On 9.10.2025, the matter was referred to the Mediation Centre for an amicable settlement between the parties. 5. At the Mediation Centre, a settlement was arrived at between the parties on 16.03.2025, and the report thereof is annexed to this petition. 6. Considering the aforesaid aspects of the matter, learned counsel for the parties submits that, in view of the mediation proceedings,
3 no dispute now survives between the parties, as they have amicably arrived at a settlement. 7. This settlement agreement entered into on this 16th day of March 2026 between M/s Shankara Enterprises, Through Partner Harihar Upadhyay (Party No. 1) and Shri Akhilesh Tiwari, OIC and Superintending Engineer on behalf of Managing Director, Chhattisgarh Medical Services Corporation Ltd., District Raipur Chhattisgarh (Party No.2). Whereas,

Disputes and differences had arisen between the parties hereto and WPC No. 4598/2021 (M/s Shankara Enterprises Vs. State of Chhattisgarh) was filed by Party No. I before Hon'ble High Court of Chhattisgarh. 2. The matter was referred to mediation vide order dated 09.10.2025 passed by Hon'ble High Court of Chhattisgarh, Bilaspur, Chhattisgarh in WPC No. 4598/2021 (M/s Shankara Enterprises Vs. State of Chhattisgarh). 3. Smt. Anubhuti Marhas, Advocate was appointed as Mediator. 4. Various meetings was held during the process of mediation on 11.11.2025, 12.12.2025, 17.12.2025, 20.01 2026, 09.02 2026, 17.02.2026, 27.02.2026 & 16.03.2026 and the parties have with the assistance of mediator voluntarily arrived at an amicable settlement resolving the above mentioned disputes and differences. 5. The parties hereto confirm and declare that they have
4 voluntarily and of their own free will arrived at this settlement/agreement in presence of the mediator. 6. The following settlement has been arrived at between the parties hereto:- A. That Party No. 2 has paid all the outstanding amount as claimed (Secruity deposit- Rs 27,76,111.99/- Final bill Rs. 72,36,209.00/-) by the Party No. 1 (Petitioner) with respect to agreement no. 88 DL 2017-2018 dated 05-04-2017 for the construction of Fifty bedded MCH wing at Bijapur including water supply and electrification work. Party No. I has received the same in his account and has willingly let go/forgone his claim of interest over the pending amount. Henceforth, neither of the parties have any claim left to be sorted out between the parties. B. In view of this memorandum of settlement between the parties the present Writ Petition Civil bearing no. 4598/2021 can be put forward for disposal before this Hon'ble Court. 7. That apart from above mentioned case it has been undertaken by both the parties they have not filed any Civil, Criminal or Police Complaints against each other in any court regarding the aforesaid case. That it is also agreed that both the parties shall not file any Civil, Criminal or Police Complaints against each other in any court in future regarding the aforesaid case. 8.
By signing this agreement the parties hereto state that they have no further claim or demands against each other with respect to WPC No. 4598/2021 (M/s Shankara Enterprises Vs. State of
5 Chhattisgarh). The agreement is signed on 16.03.2026 by the parties to the agreement in the presence of Mediator at Mediation Centre, High Court of Chhattisgarh at Bilaspur, Chhattisgarh.
