In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nabadwip Police Station Case No. 772 of 2025 dated 03.11.2025 under Section 20(b)(ii)C & 29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that there has been recovery of only 14 Kgs. of Ganja from the present petitioner, although the total recovery in the present case is 54 Kgs. of Ganja.
According to the petitioner, the prosecution case is not believable as it has been portrayed that, in a scooty 4 persons were plying with the contraband.
Learned advocate for the State submits that charge sheet has already been submitted. There are 10 witnesses who have been relied upon in the charge sheet to support the prosecution case.

Having considered the overall circumstances, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. However, that the petitioners are lady, as such the learned Trial Court is directed to examine the independent seizure list witnesses within a period of 3 months from the date of consideration of the charges are over.
At this stage, the bail application is rejected.
Learned Trial Court would adhere to the directions passed above.
With the aforesaid observations CRM (NDPS) 1215 of 2026 is dismissed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
