1. Heard Ms. Purva Jain, learned counsel for the petitioner as well as Mr. Jitendra Shrivastava, learned Government Advocate, appearing for the State/respondent No.1.
2. The present petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the petitioners with the ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA
2 following prayer :
“It is therefore prayed that, this Hon'ble Court may kindly be pleased to allow this instant petition and quash FIR bearing Crime No.894/2025 dated 29/09/2025, Charge Sheet bearing No. 191/2026 dated 13/04/2026 filed against the petitioners by the Police Station Janjgir (C.G.) for commission of offence which is punishable under section 109 (1) and 3(5) of the BNS, 2023 and the
order dated 09/06/2026 passed in Sessions Case No.70/2026, passed by Sessions Judge, District Janjgir- Champa (C.G.), whereby the Sessions Judge has registered the case against the petitioners and the entire consequential proceedings, in the interest of justice.”

Learned counsel for the petitioners submits that as during pendency of the present petition, the charge-sheet has already been submitted and charges have also been framed against the petitioners, therefore, she wants to withdraw the instant petition to challenge the same.
4. Accordingly, the instant petition is dismissed as withdrawn with liberty as prayed for.
5. Certified copy of the documents annexed with this petition be returned back to learned counsel for the petitioners after retaining photocopy of the same. Sd/- Sd/-
