Mr. Chitta Ranjan Chakraborty Mr. Sumit Banerjee Ms. Puspa Rani Jaiswara ….for the petitioner The order dated May 18, 2026 passed by the learned Civil Judge (Jr. Div.), 1st Court at Chandernagore, District- Hooghly is under challenge at the instance of the defendant no.2 in Title Suit No.447 of 2022. By the order impugned the application filed by the defendant no.2 under Section 151 of the Code of Civil Procedure for marking the documents which were marked as “for identification” as exhibits. The learned trial judge rightly recorded that to prove the documents which were marked as “for identification” the maker as well as the witness/party, who can verify the signatures and facts of the marriage should adduce evidence. The learned trial judge was right in holding that the burden lies upon the defendant no.1 to prove the veracity of the documents. The learned trial judge assigned cogent reasons for rejecting the said application. This Court is not inclined to interfere with such order in exercise of the jurisdiction under Article 227 of the Constitution. 2 In view of the above observations, CO 2201 of 2026 stands disposed of.
