Mr. Saptarshi Banik …for the Petitioner. 1. The petitioner prays for expeditious disposal of a partition suit being Partition Suit No. 29 of 2024, which is pending before the learned Civil Judge (Senior Division), Alipurduar. 2. The prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite party. 3. It appears that the suit is at a very early stage. An application for injunction is pending. The Court has fixed a date for hearing application for injunction. 4. The revisional application is disposed of with a direction upon the learned Court to make a sincere endeavour to dispose of the application for injunction within three months from the next date 2 fixed. Adequate opportunity shall be granted to the parties to contest the same. 5. This Court has not expressed any opinion on the merits of the application. The learned Court shall proceed independently and in accordance with law. Thereafter, the learned court will make an attempt to dispose of the suit in an expeditious manner. 6. A copy of the revisional application along with a server copy of this order be served upon the opposite parties and/or the learned advocate contesting the matter on behalf of the opposite parties in the learned court below, within a week. 7. The revisional application is accordingly disposed of. There shall be no order as to costs. 8. The parties are to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
