JUSTICE H.P.SANDESH ORAL ORDER The parties have filed a compromise petition under Section 147 of Negotiable Instruments Act, 1881 (for short ‘N.I. Act’), wherein they have settled the matter for an amount of Rs.15,00,000/- in full and final settlement. 2. In the compromise petition, it is stated that already an amount of Rs.3,78,000/- and Rs.2,83,500, totally Rs.6,61,500/- is deposited before the Trial Court. In view of the compromise, the respondent-complainant is permitted to withdraw the amount and the Trial Court is directed to disburse the amount in favour of the respondent-complainant on proper identification. The balance amount payable is Rs.8,38,500/- and in terms of the settlement, the accused has agreed to pay - 3 - HC-KAR CNR: KAHC010280702024 NC: 2026:KHC:36099 CRL.RP No. 690 of 2024 the said amount on 15.10.26 and has given a post-dated Cheque. 3. It is made clear that, if the Cheque is not honoured, the petitioner shall pay Rs.11,38,500/- to the respondent in view of settlement arrived between the parties. The petitioner is present before the Court and learned counsel for the respondent submits that the respondent-complainant has signed the joint memo, but due to age factor and he is aged about 80 years, he is not present before the Court. The said submission is taken on record. 4. In terms of the compromise between the parties, the accused is acquitted for the offence under Section 138 of N.I. Act subject to honouring of the cheque for Rs.8,38,500/- dated 15.10.2026 and if the petitioner fails to honour the same, the respondent-complainant is given liberty to execute and enforce the order of the Trial Court and confirmation order passed by the First Appellate Court for balance amount of Rs.11,38,500/- and if the Cheque is bounced, the petitioner need not once again litigate the matter under Section 138 of N.I. The petitioner is also directed to deposit the amount of Rs.10,000/- before the Trial Court within two weeks which shall vest with the State and produce the receipt before the Registry within three weeks.
