APP Mr. Bankim Pal … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for more than eight months and the alleged recovery in the present case is 4kg 620 gm of ganja; 50 bottles of phensedyl and charge-sheet has been submitted before the learned jurisdictional court. According to the learned advocate, some time will be required to take the trial to its logical conclusion. Learned advocate for the State opposes the prayer for bail. The records of the case reflect that the prosecution has relied upon 13 witnesses in order to prove its case. Having considered the period of detention of the present petitioner and the time which will be required to 2 take the trial to its logical conclusion, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Afajuddin Mondal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Murshidabad without prior permission of the learned Special court/trial court.
