Item- 20. sg 15-07-2026 Ct. 6 CO 2226 of 2026 Provath Karmakar alias Provat Karmakar Versus Chanda Karmakar alias Chhand Karmakar & Ors. [ None appears on behalf of the petitioner at the time of call. No accommodation has been sought for either. This application under Article 227 of the Constitution of India is directed against an order dated 4th September, 2025 passed by the learned Civil Judge (Junior Division), 2nd Court at Barasat, North 24 Parganas in Title Suit No. 714 of 2023. By the impugned order, the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure stood rejected. The order impugned being an appealable one under Order 43 Rule 1(r) of the Code of Civil Procedure, this Court is not inclined to entertain this civil revisional application. Accordingly, CO 2226 of 2026 stands dismissed as not entertained. It is made clear that this order shall not preclude the petitioner from approaching the appropriate forum in accordance with law, if so advised.
