Sri Bijay Rajak Mr. Debasis Kar Ms. Paramita Mukherjee Mr. Arka Tilak Bhadra ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court, Berhampore, District-Murshidabad to dispose of Other Suit No.69 of 2019 expeditiously. The learned advocate appearing for the petitioner submits that a Co-ordinate Bench by an order dated December 5, 2025 in C.O. 4112 of 2025 directed the learned trial judge to dispose of the pending suit within a period of six months from the next date fixed, without granting any unnecessary adjournments to either of the parties. From the order sheets appended to this application this Court finds that on May 2, 2026 the hearing of the application under Order 39 Rule 1 of the Code of Civil Procedure was adjourned on the ground of resolution adopted by the concerned Bar Association and the hearing of the injunction application was fixed on May 20, 2026. The learned advocate appearing for the petitioner submits that in the meantime the hearing of the injunction 2 application has already been completed and August 6, 2026 has been fixed for evidence of PW 1. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioners shall be obliged to forward a copy of this civil revisional application along with this order upon the opposite party or the learned advocate representing the opposite party before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2183 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court, Berhampore, District-Murshidabad to make an endeavour to dispose of Other Suit No.69 of 2019 expeditiously keeping in mind that the direction passed by the Co-ordinate Bench on December 5, 2025 in C.O. 4112 of 2025.
