Petitioner has filed this writ petition seeking following reliefs:- “10.1 The Hon’ble Court may kindly be pleased to issue a writ of mandamus directing the Respondents to give the benefit PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 of order dated 16.12.2025 with effect from the date of appointment of petitioner ie., 19.11.2015. 10.2 The Hon’ble Court may kindly be pleased to direct the respondent authority to decide the representation which was pending before the respondent authority. 10.3 Grant any other writ(s), order(s), relief(s) in favour of the petitioner, which the Hon’ble Court deemed fit & just in the facts and circumstances of the case including awarding of the costs to the petitioner.” 2. Learned counsel for the petitioner submits that petitioner was appointed on the post of Investigator vide order Annexure P-1 dated 19.11.2015. After completion of period of probation of two years, petitioner has been confirmed in service on 31.03.2018. According to the order issued by the State Government, petitioner is entitled for the benefit of pay scale according to the recommendations of the Brahmaswaroop Committee. The State Government has earlier issued an order dated 06.01.2017 for granting benefit of pay scale as per the Brahmaswaroop Committee from the date of grant of financial sanction dated 05.08.2016, however, subsequently the said order was amended vide order dated 08.06.2017 and it has been made applicable from 01.04.2006. Petitioner was though granted benefit of pay scale of the Brahmaswaroop Committee but it is made effective only from 16.12.2025. Petitioner has also submitted representation Annexure P-9 dated 13.03.2026 before Respondent No. 1, however, it is pending consideration and therefore, direction be issued to Respondent No. 1 to take decision on the representation at the earliest within specified time. 3 / 3 3. On the other hand, learned counsel for the Respondents/State submits that as the petitioner is not pressing this writ petition on merits and only seeking direction to be issued to Respondent No. 1 to consider and take decision on the pending representation of petitioner, she is having no objection to the limited prayer made by the counsel for petitioner. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, this writ petition at this stage is disposed of directing Respondent No. 1 to consider and take decision on the claim/ representation of petitioner, in accordance with law, expeditiously, preferably within a period of 03 months from the date of receipt of copy of order passed by this Court. 6.
