This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for direction upon the learned Civil Judge (Senior Division), 1st Court at Barasat, to dispose of the Money Suit no. 538 of
2023. The learned Advocate appearing for the petitioner submits that the written statement was filed long after the expiry of the prescribed period of limitation. She submits that an application for acceptance of the written statement has been filed by the defendants/opposite parties herein and such application is still pending before the learned Trial Judge. She further submits that the suit has also been fixed for ex parte hearing and the opposite parties also filed an application praying for vacating the order fixing the suit for ex parte hearing. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned
Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 1st Court at Barasat, to take up the hearing of the pending interlocutory applications on the next date fixed, if the same is otherwise ready for hearing and make an endeavour to dispose of same as expeditiously as possible but preferably within a period of 12 weeks from the next date, without granting any unnecessary adjournments to either of the parties. After disposal of the interlocutory applications, the learned Trial Judge shall make an endeavour to dispose of the Money Suit No. 538 of 2023 as expeditiously as possible. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
