Versus Amit Guha Roy [ Mr. Soumyajit Bhatta Mr. Sanjib Seth …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for direction upon the learned Civil Judge (Senior Division), 3rd Court, Howrah, to dispose of the application under Order 6 Rule 17 of the Code of Civil Procedure filed in Title Suit No. 338 of 2019, expeditiously. The learned Advocate appearing for the petitioners submits that the application is otherwise ready for hearing. From the order sheets appended to this application, this Court finds that 16th November, 2026 is fixed for hearing of the application under Order 6 Rule 17 of the Code of Civil Procedure. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 3rd Court, Howrah, to take up the hearing of the application under Order 6 Rule 17 of the Code of Civil Procedure on the next date fixed i.e. on 16th November, 2026 and, if the same is otherwise hearing, and shall make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of 12 weeks from the next date fixed, without granting any unnecessary adjournments to either of the parties.
