By the present writ petition, the petitioner seeks a direction to respondent No.2 to decide the departmental appeal dated 03.11.2020 (Annexure P/2) preferred by him. 2. Learned counsel for the petitioner submits that the services of the petitioner were dismissed vide order dated 05.09.2020, against which he preferred a departmental appeal dated 03.11.2020 before respondent No.2. Since the said appeal was not decided, the petitioner earlier approached this Court by filing WPS No.3270/2021, which was disposed of vide order dated 06.07.2021 directing respondent No.2 to decide the appeal within a period of 60 days. It is submitted that despite the petitioner furnishing a copy of the said order before the competent authority on 19.07.2021, the appeal has not been decided till date. Accordingly, it is prayed that respondent No.2 be directed to decide the petitioner's pending departmental appeal expeditiously, in accordance with law. 3. I have heard learned counsel for the petitioner and perused the material available on record. 4. Upon consideration of the record, this Court finds that the petitioner had earlier approached this Court by filing WPS No.3270/2021 seeking the very same relief as prayed by him herein. The said writ petition was disposed of with a specific direction to the competent authority to decide the petitioner's departmental appeal within the stipulated period. Therefore, the relief sought in the present writ petition is identical to the relief already granted by this Court. As such the present writ petition is 3 not maintainable. 5. It is well settled that once a writ petition has been decided and the relief sought therein has already been granted or considered, the petitioner cannot seek the very same relief by filing a fresh writ petition. In the absence of any fresh cause of action, this Court does not find any ground warranting interference in exercise of its writ jurisdiction. 6.
