The petitioner, an applicant before the West Bengal Administrative Tribunal (in short ‘Tribunal’) is seeking a substantial relief of acceptance of his resignation from the post of Professor, Department of Gynaecology & Obstetrics in the Midnapore Medical College & Hospital, Paschim Medinipur with effect from 01.06.2025. 2. The learned advocate for the writ petitioner has handed over a copy of an order dated 01.07.2026 issued by the Special Secretary to the Government of West Bengal whereby and whereunder he has been communicated acceptance of the petitioner’s resignation and as a consequence thereto, his past services were forfeited. The order further obligates the petitioner to refund one month and 23 days of salary and completion of the formalities 2 including other financial obligations, if any, on the part of the writ petitioner before issuance of a formal release order. 3. The learned advocate for the writ petitioner, therefore, submits that the prayer made in the writ petition is rendered infructuous on account of the order dated 01.07.2026 issued by the Special Secretary to the Government of West Bengal. 4. Accordingly, the writ petition is disposed of. Copy of the order dated 01.07.2026 is kept on record. 5. The parties are in agreement that in view of the order dated 01.07.2026, pendency of the Original Application bearing O.A. No.493 of 2025 before the West Bengal Administrative Tribunal, would serve no useful purpose and would be futile. 6. The Original Application (O.A. No.493 of 2025) stands disposed of accordingly.
